Variation of Agreements or Court Orders

Your separation may be finalized by a Separation Agreement or a Court Order. However, there may be circumstances that require you to seek a change to the parenting schedule or support arrangements. In order to seek a variation of a final Separation Agreement or a final Court Order, there must be a “material change in circumstance”. The material change in circumstance must give rise to a set of circumstances that did not exist at the time of the negotiation of the final Separation Agreement of at the time the Court made the Court Order.

In order to seek a variation of a final Separation Agreement or final Court Order, you may have to commence a Motion to Change proceeding through the Court. You may consider commencing this process if you are seeking to change a term or terms of your agreement or Court Order based on a material change in circumstance.
